MWI Business & Commercial Mediation Overview

Mediation resolves disputes quickly, efficiently and early so that parties can get back to business. MWI’s skilled mediators help parties identify hidden interests and settlement options that may not be apparent in conventional negotiation or allowed in traditional litigation.

While litigation is necessary for certain disputes, it will not preserve or improve business relationships. Take for example change orders in construction, overdue royalty payments in franchising, misuse of intellectual property post-termination, quality and timeliness of product delivery, failure to provide necessary services; as these commercial issues languish in the court system, everything is put on hold.

William Baten, IN - A mediator since 1987, Mr. Baten has participated in over 1500 mediations and arbitrations.  Currently serving as mediator to the biggest construction project in the U.S., the ‘Big Dig’ in Boston, Mr. Baten’s extensive experience in resolving franchise issues includes encroachment, resale of vehicles in Canada and overseas, gender discrimination, termination, realignment of brands and audit issues. Michael Dickstein, CA - Michael Dickstein has worked as a mediator and arbitrator of complex commercial, employment, class action, and other disputes, and a teacher of negotiation and mediation, since resigning as a partner in one of America's leading law firms in 1992. Mr. Dickstein teaches negotiation at Stanford Law School, and has extensive mediation training experience worldwide, from the US to Canada, Australia, England, Ireland and the Caribbean. Charles Doran, MA - Charles Doran is an experienced mediator, trainer and facilitator specializing in the resolution of business, commercial and workplace disputes. Mr. Doran is a member of several ADR panels, including the World Bank Group, AT&T, NASD and the Harvard Mediation Program. Mr. Doran is also a member of the CPR Institute’s Panel of Distinguished Neutrals, focusing on franchise and commercial disputes for a major US automotive manufacturer. David Hoffman, MA - David Hoffman serves as mediator, arbitrator and case evaluator in a wide variety of cases and he is chair-elect of the ABA Section of Dispute Resolution.
