Customized Onsite Mediation Training

Since 1994, MWI has been a leader in customized in-house mediation training.  Top companies and institutions such as Coca-Cola, Bose, General Motors and the Fletcher School at Tufts University have engaged with MWI to prepare participants to become effective mediators.  Our skilled trainers optimize participants’ learning experience through lectures, demonstrations, interactive exercises, supervised role-plays and group discussions.  Participants will receive coaching, instruction, and opportunities to practice their newly acquired skills.  MWI's mediation trainings meet the training requirement outlined in the Massachusetts Confidentiality Statute (MGL ch233 sec 23C) and Rule 8(c)(i) of the MA Supreme Judicial Court's Uniform Rules on Dispute Resolution.


Program Methodology:

Learning objectives:  Participants will learn
  • About mediation and other ADR (Alternative Dispute Resolution) methods, including an overview of mediation theory, approaches and styles (facilitative, evaluative, transformative, etc…);
  • The initial stages of the program are dedicated to helping participants understand the goals, elements, structure and stages of mediation. Special emphasis is placed on helping participants understand and implement the principles of mediation and what steps the mediator can take to uphold these principles (which include confidentiality, impartiality, informed consent, self-determination and the voluntary nature of mediation);
  • The role and skills of a mediator, which include: setting the stage, defining issues, identifying interests, transmitting information, communicating effectively, generating options for resolution, analyzing alternatives and drafting agreements;
  • Mediation as “assisted negotiation”; mediating with a co-mediator; solo mediation techniques; How mediation can be applied and promoted;
  • Ethical duties and dilemmas facing mediators; mediation and confidentiality; the role of agents, witnesses and other advocates at the mediation table;  Mediator liability; confidentiality and privilege;
  • Interactive listening techniques; the art of effective questioning; reality testing and the mediation process; overcoming barriers to agreement;
  • Dealing with challenging personalities, mediator biases and challenges to neutrality.  Dealing with power differentials and imbalances;
  • The state of the field; recent developments, trends and mediation resources including information on mediation and ADR web sites, blogs, listservs and other information.
  • Determining when a case should be mediated internally and when it should be referred to an external mediation provider; How to use mediation skills even when the trained mediator is not serving in a formal mediation session.

Expected Outcomes: As a result of this training, participants will be able to –
  • Effectively facilitate the mediation process - from the mediator’s opening to agreement writing;
  • Assist parties in their efforts to define the issues, focus their interests and generate options that secure sound resolutions;
  • Provide participants with the skills necessary to mediate effectively including listening skills, questioning techniques, fostering communication, generating options and analyzing alternatives.
